Terms of Use

These terms set the rules for using Pool Duel, including the responsibilities of commissioners and participants in private salary-cap contests.

Agreement and operator

Pool Duel is founded and operated by Ryan Hache in Kitchener, Ontario, Canada. By creating an account, joining a pool, or otherwise using Pool Duel, you agree to these Terms of Use and our Privacy Policy.

If you use Pool Duel for an organization or group, you confirm that you have authority to accept these terms on its behalf.

What Pool Duel provides

Pool Duel provides software for private, commissioner-run sports contests. Features may include salary-cap lineups, contest invitations, lineup locks, live scoring, ownership percentages, standings, player information, and commissioner controls.

Pool Duel is not a sportsbook, casino, payment processor, escrow service, or prize administrator. Pool Duel does not collect entry fees, hold pool money, determine who must pay, or distribute prizes.

Accounts

  • Provide accurate information and maintain control of your email account.
  • Use a unique password and do not share access to your account.
  • You are responsible for activity performed through your account unless you promptly report unauthorized use.
  • Usernames and profile images must not impersonate others, infringe rights, or contain abusive or illegal content.

Commissioner responsibilities

Commissioners create and administer private pools. The commissioner is responsible for clearly communicating pool rules, eligibility, any entry fee or prize arrangement, tie-breaking, cancellations, disputes, taxes, and any local legal requirements.

If a commissioner chooses to arrange money or prizes outside Pool Duel, that arrangement is solely between the commissioner and participants. Pool Duel is not a party to it and does not guarantee payment or collection.

Participant responsibilities

Participants are responsible for reviewing the pool rules, confirming that participation is legal where they live, submitting a valid lineup before lock, and resolving payment or prize questions directly with the commissioner.

You must be legally capable of accepting these terms. If you are below the age of majority where you live, a parent or guardian must authorize your use. Contests involving money or prizes may have additional age and location restrictions.

Lineups, locks, and scoring

Lineups may be edited until the applicable lock time shown in the service. Device time, connectivity, delayed submissions, or third-party feed timing do not extend a lock. Pool Duel may correct an obvious lock-time or data error when reasonably necessary for contest integrity.

Scoring depends on third-party sports data and the rules shown for a pool. Official statistics can be delayed or corrected after an event. We may recalculate standings when a data provider issues a correction. Pool Duel does not guarantee that every score, player status, image, salary, or statistic will be error-free or continuously available.

Acceptable use

  • Do not access accounts, pools, or data without authorization.
  • Do not exploit, scrape at disruptive volume, reverse engineer, interfere with, or bypass security or lineup privacy controls.
  • Do not use Pool Duel to facilitate illegal gambling, fraud, money laundering, harassment, or other unlawful activity.
  • Do not upload malicious code or content that violates another person’s privacy, publicity, intellectual-property, or other rights.

Content and intellectual property

Pool Duel and its original software, design, branding, and content are owned by the operator or licensed to Pool Duel. You receive a limited, revocable, non-transferable right to use the service for its intended purpose.

You retain rights in profile content you submit and grant Pool Duel permission to host, resize, display, and process it only as needed to operate the service. Sports leagues, teams, events, athletes, and third-party brands retain their respective rights.

No affiliation

Pool Duel is an independent product. It is not affiliated with, endorsed by, sponsored by, or operated by FanDuel, DraftKings, any sports league, team, tour, event organizer, broadcaster, or athlete. References to third-party contest styles are descriptive only.

Availability and changes

We may add, change, suspend, or remove features; correct data; impose reasonable usage limits; or discontinue the service. We may restrict or terminate access when these terms are violated, security is at risk, or law requires it.

Disclaimers

Pool Duel is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes a warranty or right that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Pool Duel and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or data; unavailable service; scoring corrections; missed lineup submissions; or disputes over entry fees or prizes. Pool Duel’s aggregate liability arising from the service will not exceed the greater of CAD $100 or the amount you paid directly to Pool Duel in the preceding 12 months.

Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to any mandatory consumer rights, disputes will be brought in the courts located in Ontario.
